PLEASE READ THE FOLLOWING PRIOR TO SHIPPING WITH PARCEL PRO INC. USE OF PARCEL PRO, INC. SERVICES CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS
PARCEL PRO, INC. ACTS AS A FACILITATOR TO ARRANGE CARGO INSURANCE AND TRANSPORTATION ON BEHALF OF ITS CUSTOMERS/SHIPPERS.
PARCEL PRO, INC. IS NOT AN INSURANCE COMPANY.
PARCEL PRO, INC. IS NOT AN AIR CARRIER OR INDIRECT CARRIER SUBJECT TO THE WARSAW CONVENTION.
The insurance policy issued to Parcel Pro, Inc. only covers loss/damage during the course of transit for stated commodities and is subject to the Terms and Conditions and Parcel Pro, Inc.'s Shipping Guide-Rules and Restrictions.
All claim decisions are made by the underwriters of the issuing insurance company.
All coverage is subject to confirmation by Parcel Pro, Inc.
Customer/Shipper will direct all lawsuits on issues relating to payment of claims for loss or damage or with respect to insurance coverage, to the insurance company(s) and not Parcel Pro, Inc.
It is the shipper's responsibility to report their shipments to Parcel Pro, Inc., on the same day each shipment is sent. Shipments without same day confirmation of receipt of report shall be treated as uninsured shipments.
DECLINING REQUEST FOR COVERAGE. In order to ensure that its customers continue to enjoy the preferred insurance rate, Parcel Pro, Inc., in its sole and absolute discretion, may decline a request for or confirmation of insurance coverage on certain shipments.
COVERED COMMODITIES : The insurance policy provided to Parcel Pro, Inc. covers for all lawful goods and/or merchandise consisting of jewelry, gemstones and similar goods.
LIMITS OF LIABILITY : Please refer to your Certificate of Insurance for the applicable limits of liability, which shall determine your maximum coverage(s).
VALUATION CLAUSE : There are two ways to determine the value when declaring insurance to Parcel Pro, Inc.: (1) at your invoice value or (2) at your replacement cost.
UNDERSTATING THE INSURED VALUE: In the event of loss where the insured value is less than the loss, the maximum that will be paid is the insured value.
OVERSTATING THE INSURED VALUE: In the event of loss where the insured value is greater than the loss, the maximum that will be paid is the actual value of the loss.
COMMENCEMENT OF COVERAGE: Coverage for a Parcel Pro, Inc. confirmed shipment begins after the package is tendered to the approved staffed carrier. Proof of tender will derive from the tracking information received from the approved carrier.
COVERAGE OF SHIPMENT TERMINATES: Coverage for a Parcel Pro, Inc. confirmed shipment ends when delivery is made. Delivery is when a package is signed for at the delivery location, or if a residence when left at the residential location. Delivery information is based on information provided by carrier.
IMPORTANT NOTICE REGARDING FRAUD: Parcel Pro, Inc.'s policy does not cover claims arising directly or indirectly from fraud/dishonesty/negligence, including but not limited to credit card fraud, check fraud, C.O.D. fraud, mail fraud or any fraud on behalf of the shipper/recipient or their employees.
OTHER EXCLUSIONS : The insurance policy provided to Parcel Pro, Inc. does not provide coverage for the following:
goods shipped by non-approved couriers or package service, or by any other non approved mode of transportation
shipments made subject to a "waiver of signature" or similar agreements on record with carriers
loss or damage after shipment is left at residence unsigned and unattended
packages dropped in unmanned drop boxes or non carrier staffed collection points
loss or damage caused by unexplained loss, mysterious disappearances or shortage disclosed upon taking inventory
damage to and/or breakage of items of glass, wood or other fragile material such as those used for clocks, glassware, musical instruments, etc ...
C.O.D. SHIPMENTS CAN BE INSURED; HOWEVER, C.O.D. PAYMENTS ARE NOT COVERED. Parcel Pro, Inc. is not responsible for the collection or return of C.O.D. payments.
ALL CLAIMS MUST BE REPORTED WITHIN 24 HOURS OF LOSS BUT NO LATER THAN 7 DAYS FROM SHIP DATE. Failure to report a claim timely will nullify the insurance coverage.
COOPERATION IN CLAIMS PROCESS. Customer/Shipper, agents of Customer/Shipper, and recipient shall cooperate in providing documentation and other information pertinent to a claim for loss or damage, including examination under oath.
Parcel Pro, Inc. reserves the right to place a lien on settled claims to apply to shipper's unpaid balance with Parcel Pro, Inc.
TERMS OF INSURANCE POLICY CONTROL. Under all circumstances, the terms and conditions set forth in the insurance policy issued to Parcel Pro, Inc. shall control in determining issues concerning insurance coverage. To the extent that any terms and conditions stated herein conflict with those in the policy of the issuing insurance company, the terms and conditions of the policy shall control and be binding as to issues of insurance coverage. You may make a written request to obtain a copy of the policy.
RATE/PRICING. Shipment pricing and rates shall be as provided to customer by Parcel Pro, Inc. Customer/Shipperagrees to pay the rates provided and to comply with all the terms of credit, if any.
RULES AND PROCEDURES FOR SHIPPING: Consideration of a claim or loss shall be conditioned upon Customer/Shipper observing the rules and procedures detailed in the Parcel Pro Shipping Guide-Rules and Restrictions, which are incorporated herein by this reference.
ENTIRE AGREEMENT . This Agreement together with the Parcel Pro Shipping Guide-Rules and Restrictions, and Rate Sheet, shall constitute the entire agreement between Parcel Pro Inc. and its Customer/Shipper. No oral modification of the terms and conditions is permitted by either party, and no Parcel Pro employee shall have authority to orally modify any terms and conditions. All modifications must be in writing by Parcel Pro Inc. The Insurance Policy issued to Parcel Pro, Inc. shall control on issues of coverage.
JURISDICTION AND VENUE . Any Judicial claim or action arising out of this Agreement, or shipment by or through Parcel Pro, Inc. must be filed in San Diego Superior Court, in San Diego, California. All Parties agree to forebear from bringing a claim in any other county or jurisdiction. California law shall apply.
AMENDMENTS TO TERMS AND CONDITIONS : Parcel Pro, Inc. may modify these Terms and Conditions with notification to its Customers/Shippers. Use of Parcel Pro, Inc. services after notification shall constitute Customer/Shipper acceptance.
We reserve the right to charge your credit card for any overdue balances regardless of billing method. Any past due amount may be subject to an interest charge of 1.5% per month.
